Approved commercial third parties must follow the policy below:
Third-Party Commercial Filming Policy at ASAA Events
-
Permit Required: All third-party commercial filming, promotional shooting, or brand content creation requires written approval from event management at least 48 hours prior to arrival.
-
Media Passes: Approved creators must always wear a visible media pass, and adhere to the agreed filming schedule, which may be outside public opening hours to avoid disrupting buyers.
-
Location Fees: Management reserves the right to charge a commercial location fee or require a revenue-share agreement if the footage is directly monetized.
Artist Copyright and Intellectual Property
-
No Direct Monetisation: Third parties may not feature individual artworks as the primary subject of a video if that video is used to sell a non-art product, service, or digital subscription (e.g., a fashion brand using an artist's painting as a background without permission).
-
Mandatory On-Screen Credit: If an artwork is clearly identifiable, the video must explicitly credit the artist's name and artwork title via an on-screen lower-third or in the primary text caption.
-
Incidental Background Only: Generally, filming is restricted to wide-angle "atmosphere" shots of the crowd and gallery. Close-up, high-definition filming of specific artworks is strictly prohibited unless explicit written sign-off is granted by the specific artist.
Operational and Safety Restrictions
-
No Disruption to Sales: Filming must not block lines of sight to artworks, crowd flow, or access to sales desks.
-
Equipment Limitations: Heavy equipment, large lighting rigs, booms, or drones are strictly prohibited. Handheld gimbals and small, non-tripod setups are acceptable.
-
Public Privacy: Third parties must obtain verbal or written consent from any members of the public who are prominently featured in the footage.
Liability and Indemnity
-
Damage Liability: The third-party production team is 100% financially liable for any accidental damage caused to the artworks or the venue by their crew or equipment.
-
Proof of Insurance: Third parties must provide proof of Public Liability Insurance (usually a minimum of $2 million to $5 million NZD) before setting up equipment.
-
Content Takedown Rights: ASAA management reserves the right to demand the immediate removal or editing of any published content that misrepresents the event, breaches artist copyright, or violates local cultural protocols.
Content Ownership and Rights Assignment
-
Footage Ownership: The third-party content creator retains the raw copyright of the filmed footage, subject to the limitations of the artist's intellectual property rights and those of ASAA.
-
Show Promotion Licence: By filming at the event, the third-party creator grants ASAA a perpetual, royalty-free, worldwide licence to reuse, crop, and share the finished video clips on the show's official website, social media channels, and marketing materials.
-
No Stock Footages/Resale: The third party may not sell, licence, or distribute the footage to third-party stock libraries (e.g., Shutterstock, Getty Images) or other commercial brands, as the underlying artworks remain the sole property of the artists.
-
Trademarks and Logos: These are owned by Jackfish ltd and our partners and sponsors. The use of these is prohibited without the express, prior written permission of Jackfish ltd or any relevant third party.
